SC nods for Local body polls in AP
Here is a big relief and support to the government of Andhra pradesh as the supreme court has cleared a hurdle for local body polls with 50 percent reservation limit for weaker section people. It can be considered to a jolt for TDP leaders, who are intentionally obstructing the elections as they are scaring of defeat. Any how on Wednesday division bench of the Supreme Court led by Justice Arun Mishra upheld the earlier judgement of the state high court stating that the total reservations in the local bodies should not exceed 50 per cent.
The Supreme Court which heard then petitions filed by the TDP leaders, directed that the state should stand by the earlier judgement delivered by Constitutional bench of the Supreme Court in 2010 regarding the upper limit of the reservations. The judgement said the total percentage of reservations including those for SCs, STs and BCs should not be exceeded 50 per cent. It was no defended by the division bench. The petitioners like K Ram Mohan Naidu, Kollu Ravindra, Konakalla Narayana and Palla Srinivas argued that the government could enhance the reservations under special circumstances. But now the SC ruled that the quota should not exceed 50 per cent.
With this judgement, the state government can proceed to conduct the elections at anytime after the lockdown situation is relaxed and the conditions come normal.
